definitions

In this Agreement, unless the context requires otherwise, the following terms shall have the meanings referred to:

MandyStation application, "application", "management", "we", "the pronoun of the speaker" or "the possessive pronoun": refers to the Delicious Stations Restaurant Corporation for serving meals
• “Account”: the space allocated to you in the application that enables you to benefit from the services of (Mandi Station) application.
• "User / you / you": any person who creates an account, uses the Application or is active on the Application.
• "Content": refers to all text, graphics, images, and any materials. Others entered, processed, included or accessed through the Application.
• “Services”: includes the services or products provided by MandyStation that are provided through the application, such as meals, drinks, and others.
• "Agreement": refers to this document and the terms and conditions it contains, as well as the privacy policy, and all agreements and policies that complement and implement your agreement with us.

Consent and legal capacity

- Your access and use of the (Mandi Station) application requires that you acknowledge that you have the legal capacity necessary to enter into this agreement with us, and that you are at least 18 years old, and if you are a minor (not reaching the specified age), you can use the application services under the supervision of one of your parents or legal guardian provided you agree to be bound by the terms of the Terms of Use.

Access our application

- We do not guarantee that our application or any content on it will always be available or uninterrupted. Access to our Application is permitted on a temporary basis, and we may suspend, withdraw, discontinue or change all or any part of our Application at any time without prior notice.
- We will not be liable to you if any part of our application is unavailable or interrupted at any time or for any period.

General Provisions
As a condition of your access to and use of the Application or the Services, you agree to:

3. Registration and account use
You must create an account with us to use our services in the application.
- You are responsible for any disclosure of this information to others, and you are also responsible for any use by any person to whom this confidential information has been disclosed.
- You undertake to inform us immediately of any hacking, theft or discovery of any illegal use of your account in the application, so that we can take the necessary technical measures to maintain the account.
- We have the right, at our sole discretion, to ban or cancel accounts that violate the terms of the application without consulting or alerting the user.
- The User acknowledges immediate compliance with these Terms and Conditions, as well as any sub-terms and conditions specific to each Service.

Violation of the Privacy Policy or Agreement
- In the event of a violation of the privacy policy or the service agreement with the (Mandi Station) application, the (Mandi Station) application has the right to terminate the user's account without prior notice; And when the customer attempts to harm the (Mandi Station) application, including but not limited to the (Mandi Station) application system, its servers, reputation, business, services, network, operations or equipment, he will be held legally liable.
- The customer has no right to defame the (Mandi Station) application or insult its employees or administrators, knowing that the attempt to defame or defame - in any way - gives the (Mandi Station) application the full right to refuse to provide any service to the customer, he will be held legally accountable.
- We also stress that you are responsible for maintaining the security of your account and are fully responsible for all activities that occur using your account and any other actions that take place to connect to the (MandiStation) application through it, whether through your main account.

circumvention
When the customer circumvents or circumvents any technologies used in the customer area of the (Mandi Station) application, this is an explicit violation of the terms of use of the application, and he will be held legally accountable.

General obligations and rights
The (Mandi Station) application undertakes to work for the convenience of the customer, to provide the best services, to continue developing them, and to make any effort to provide the service.
The (Mandi Station) application undertakes to keep the customer's personal data complete and in strict confidentiality, and it will not be disclosed to any party except for governmental or international agencies in the event of an official request, and the customer will be notified directly when that information is disclosed to the parties unless the subject requires otherwise.

General agreements
(Mandi Station) application has the right to suspend or cancel part or all of the services provided to the customer when it deems that these services have been used inappropriately. MundiStation also reserves the right to refuse or not provide the service.

 

Prohibited uses
All users are prohibited from:
- Use the Application, Service or Content in any way, at our sole discretion, in a way that damages our reputation or trademark.
- Using the application to infringe or violate our intellectual property rights.
Post, transmit or otherwise introduce any material that contains viruses or any other malicious software or any other malicious code, files or other computer programs designed to damage, interfere with or limit the normal operation of the Service (or any part thereof), or of any other computer software or hardware .

We reserve the right to terminate your use of the Service for any violation or prohibited use.

Limitation of liability
- You expressly agree that you use the (MandiStation) application at your own risk.
- You agree not to use the (MandiStation) application or any service provided through it in an illegal or fraudulent manner.
- You agree to compensate us for any losses or damages resulting from non-compliance with these terms and conditions or because of your violation of these terms and conditions, and you must bear the costs and expenses of direct and indirect claims whatsoever and bear the legal liability whatsoever (criminal or civil) and all necessary compensation for us or to others.
- We make all reasonable efforts to ensure that all transactions are processed in a timely manner, however (MandiStation) application does not commit itself with regard to the amount of time required to complete the processing of any particular transaction and also will not be responsible for any direct or indirect loss arising from any delay Like this.

Exemption from liability
• We provide our services "as is" and "as available", without any representations or warranties of any kind, whether express or implied, related to the use of (MandiStation) application, its content or the services provided on it.
• We will not be liable to you or anyone else for any loss arising out of something over which we have no control, including failure of electronic or mechanical equipment or communication lines (including telephone and Internet), illegal access, corrupted code, or Theft, operating errors, severe or unusual weather conditions (including floods, earthquakes, or natural disasters of all kinds) or in the event of war or force majeure.
• We are not responsible - in any case - for any direct, indirect or consequential loss resulting from:
- Use or inability to use the application.
- Any error, omission or inaccuracy of the application or its content.
- We do not guarantee or commit that the application will not be temporarily suspended due to any malfunction or that it will be free from problems or errors.
• To the (Mandi Station) application, based on what its administration deems, not to run the application according to what it deems necessary.

In all cases, the (MandiStation) application will not bear any responsibility for any damages or indirect consequences, moral or consequential damages.

disputes
Any disputes arising out of or related to these terms, including any inquiries about the existence, validity or termination of this document, shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia.

Some restrictions
The rights granted to you in this Agreement are subject to the following limitations:
1- You may not license, sell, rent, transfer, assign, distribute, host or otherwise exploit the Service.
2- You may not modify, translate, adapt, combine, make derivative works of, or disassemble any part of the Application.
3. You may not access the Service or Application in order to create similar or competitive Services or Application; Except as expressly provided herein, no part of the Application may be copied, reproduced, distributed, republished, downloaded, displayed, transmitted or transmitted in any form or by any means.

publicity and announcement
Your subscription to the (MandiStation) application automatically entitles you to receive messages, special and promotional offers, postal newsletters or text messages from the application. These messages are used to inform you and alert you of any changes, features or new activities added to the application that we think may be of interest to you.

Financial transactions, accounts and bills

• payment method:
- The customer can choose between different payment methods on the (MandiStation) application, which are at the present time: credit cards - mada - apple pay or direct payment such as online and cash payments.
- Payment via the Internet, the customer is obligated to choose one of the payment methods available upon request, as online payment operations will be dealt with through online payment service providers.

Price and payment:
- When your order is accepted, this represents an agreement between you as a customer and the application, and in the event that you choose to pay by direct payment or prepayment through the application, then the transaction will be carried out through the (Mandi Station) application, and delivery fees or any other fees will be calculated for each Request and will be clearly displayed in the order summary.
- The credit or prepaid cards that the customer uses to pay through the electronic payment gateway on the (Mandi Station) application must belong to the same customer. In the event that the ownership of the card belongs to another person, the customer must use it legally, with the approval of the card owner, and (Mandi Station) shall not bear any responsibility.
- The customer is fully responsible for executing and submitting the order using the electronic payment service after carefully reading all the terms and conditions.

 

Delivery policy:
- We seek in the (Mandi Station) application to make the delivery process quick and enjoyable, as we realize the importance of receiving your order in a timely manner and in excellent condition.
- During any order delivery process that is carried out by restaurants, and in the event that the customer is not present at the address specified in the system, the orders requested by the customer will not be delivered to any other place. In this case, the customer must accept all legal responsibilities arising from requesting a service to an address in which he does not reside, and the account will be suspended, debited or closed.

susceptibility
The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision, and any invalid or unenforceable provision shall be deemed to be severed from this Agreement to the extent of its invalidity or unenforceability, and this Agreement shall be interpreted and implemented as If the agreement does not include this special clause to the extent that it is invalid or unenforceable.
- If a court of competent jurisdiction finds any term or clause in this Agreement to be invalid, illegal or unenforceable, this shall not affect the other terms or clauses contained in this Agreement or all of them, but such term or provision shall be amended to the extent necessary in The opinion of the court to make such a condition or clause enforceable, and the rights and obligations of the parties shall be construed and applied accordingly, while maintaining to the maximum extent permissible the intentions and agreements of the parties herein.

modifications
- We have the right, at any time, to make any modifications, improvements or changes that we deem necessary to the (MandiStation) application to increase its effectiveness, and the user is bound by any directives or instructions provided by the application to him in this regard.
We reserve the right at any time and at our sole discretion to revise these Terms of Use by amending or changing any or all of these Terms. Each time you wish to use the (Mandi Station) application, you must review these terms of use periodically and to ensure that you understand the terms that apply at that time. Your continued use of the (Mandi Station) application constitutes your acceptance of the terms and conditions applicable at the time of your use of the application.

termination
- We reserve the right, according to our sole discretion, to terminate, restrict or stop any user from accessing or using the application without notice and for any reason and without giving any reason, or any behavior that (MandiStation) application management may consider illegal or harmful to others, including without limitation, if we reasonably believe that you have violated this Usage Policy or any other relevant policy, or that you pose or expose us to potential legal risk.

Total agreement
The terms of use and any operating policies or rules published by us on this application or in relation to the services represent the entire agreement and understanding between you as a user and (MandiStation) application that governs your use of the service and supersedes any previous agreements regarding the subject matter of this agreement, whether written or oral.
- In the event that we are unable to apply any right or article of these terms of service, this is not considered a waiver on our part.
- If any provision of this Agreement is held to be illegal, invalid or unenforceable, in whole or in part, under any law, then such provision or part thereof shall, to the extent such provision or part thereof not be deemed to form part of This Agreement, without affecting the legality, validity and enforceability of the other provisions of this Agreement.

applicable law and dispute resolution
- This agreement is governed by the “Terms and Conditions” and any disputes, claims or disagreements arising from or related to any violation, termination, implementation, interpretation, validity, or use of the application or services, of the laws and regulations in force in the Kingdom of Saudi Arabia.
- To the maximum extent permitted by law, these terms and conditions and conditions of services are subject to the applicable law in the Kingdom of Saudi Arabia, and all disputes arising from these general terms and conditions and the services we provide must be settled exclusively before the competent courts in the Kingdom of Saudi Arabia.

Agreement language
The Arabic language is the approved language in drafting the terms and conditions of this agreement.
